Terms and Conditions
GMAPT Prozessfinanzierung & Transporte GmbH
1. Scope
These Terms and Conditions apply to all contracts, offers and services of GMAPT Prozessfinanzierung & Transporte GmbH („GMAPT“) towards entrepreneurs within the meaning of § 1 of the Austrian Consumer Protection Act. Deviating terms of the customer apply only if GMAPT has expressly agreed to them in writing.
2. Offers and conclusion of contract
Offers by GMAPT are non-binding. A contract is concluded only upon written order confirmation or performance of the service. Services and conditions are agreed individually – individual quote on request.
3. Services
GMAPT provides services in the fields of transport and logistics, litigation funding, temporary staffing, and trade. The type, scope, dates and other details of the service result from the respective offer or order confirmation. Partial performance is permitted.
4. Prices and payment
All prices are quoted in euros plus statutory VAT unless otherwise stated. Invoices are due without deduction within 14 days of the invoice date unless otherwise agreed. In the event of late payment, the statutory default interest for business transactions applies, as well as a claim for reimbursement of reasonable collection costs. Set-off and retention rights of the customer are excluded unless the counterclaim has been legally established or acknowledged by GMAPT.
5. Customer cooperation
The customer ensures that all information, documents and access required for the performance of the service are provided in a timely and complete manner. Delays resulting from missing or incorrect information provided by the customer are not the responsibility of GMAPT.
6. Liability
GMAPT is liable only for damage caused intentionally or by gross negligence. Liability for slight negligence, consequential damage, loss of profit and indirect damage is excluded to the extent permitted by law. Liability is limited in amount to the order value of the respective order.
7. Retention of title
Delivered goods remain the property of GMAPT until all claims arising from the business relationship have been paid in full.
8. Data protection
Personal data is processed exclusively for contract execution and on the basis of the applicable data protection regulations (GDPR, Austrian DSG). Details can be found in the privacy policy on this website.
9. Final provisions
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of performance and exclusive place of jurisdiction is Vienna. If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected.
